Capital One Browser Extension Scam Lawsuit Investigation

A 2025 lawsuit filed by two creators, Jesika Brodiski and Peter Hayward, alleges that the Capital One Shopping browser extension may be stealing sales commissions from creators by replacing affiliate browser cookies when a consumer uses the extension at checkout—thus taking credit for the creator’s sale.

Creators claim to expose a massive Capital One commission scam:

In January 2025, creators filed a lawsuit against Capital One for deceptively stealing sales commissions through its Capital One Shopping browser extension which is advertised to find discount codes and compares prices at approximately 30,000 online retailers. There is an industry standard called “last click attribution” which gives credit to the last link or website a consumer clicked on before making a purchase. The Capital One Shopping browser extension allegedly uses a sneaky process of removing the affiliate marketer’s cookies at the end of the consumer’s purchasing journey, to essentially guarantee it will “win” the last click, so that Capital One gets any commissions for the sale, rather than the individual or site that motivated the consumer to buy the product(s). 

The plaintiffs claim their income was negatively impacted by Capital One’s scheme to “usurp commissions” from purchases where creators should be rightfully credited.  

The lawsuit also claims that the plaintiffs could: “face future harm in the form of stolen referral fees and sales commissions because the Capital One Shopping browser extension continues to steal affiliate marketing commissions with each passing day.” as reported by Black Enterprise.
