Partner Michael Schrag Discusses Lumber Liquidators Litigation at AAJ Webinar

Gibbs Law Group partner Michael Schrag joined a team of three other faculty members this afternoon to host an American Association for Justice webinar concerning the Lumber Liquidators litigation. Members of AAJ who registered to attend heard faculty discuss the history of the company, the science implicated in the formaldehyde wood flooring case, and how to build the best case for the plaintiffs.

Hundreds of lawsuits have been filed against Lumber Liquidators nationwide in the wake of a 60 Minutes report that exposed the company’s Chinese factories and alleged non-compliance with laminate wood emissions standards. According to the report, Lumber Liquidators Chinese-made laminate wood flooring contains noxious levels of formaldehyde in excess of regulations set forth by the California Air Resources Board (CARB).

At today’s webinar, Mr. Schrag discussed how to build the best case against the defense. His presentation provided context for the case via an exploration of CARB standards; Lumber Liquidators’ product guarantees; and the implication of formaldehyde in laminate wood manufacturing. He shared insights on client intake, expert witnesses, and formaldehyde testing.

Gibbs Law Group has filed three federal lawsuits against Lumber Liquidators which are currently pending in the Northern District of California. The lawsuits seek restitution and economic damages for consumers who purchased Lumber Liquidators Chinese manufactured laminate wood flooring, and allege that the company misled its customers when it represented this flooring as CARB-compliant.

Lumber Liquidators pulls flooring from its stores nationwide

On May 7, 2015, the Wall Street Journal reported that “Lumber Liquidators Holdings Inc. is pulling all of its Chinese-made laminate flooring and has brought on a former Federal Bureau of Investigation director to review its sourcing procedures amid widespread concern over the safety of its products.” Lumber Liquidators has sold approximately $200 million or more in laminate wood flooring products annually since 2012.
