Gibbs Law Group and Sauder Schelkopf Sue Pacific Fertility Center Following Catastrophic Equipment Failure

Thousands of Eggs and Embryos Were Put at Grave Risk by the Unprecedented Storage Tank Malfunction

SAN FRANCISCO–(BUSINESS WIRE)–Oakland-based law firm Gibbs Law Group LLP along with the law firm of Sauder Schelkopf LLC have filed a class action lawsuit in San Francisco on behalf of patients whose eggs and embryos were harmed following a large-scale equipment failure at the Pacific Fertility Center in San Francisco. The lawsuit alleges, among other things, that Pacific Fertility Center was negligent in failing to properly maintain its cryo-preservation equipment, which may have rendered thousands of eggs and embryos no longer viable. The victims assert that Pacific Fertility Center broke the law in failing to adequately maintain, inspect, monitor, and/or test its liquid nitrogen storage tanks in accordance with industry standards. Specifically, it is alleged that Pacific Fertility Center failed to maintain a functional electronic tank monitoring system capable of detecting a rise in temperature or a drop in liquid nitrogen levels and promptly alerting staff to the immediate problem. Plaintiffs also claim that Pacific Fertility Center failed to keep the eggs and embryos safe and secure, in breach of the patients’ contracts.
