Gibbs Mura, A Law Group Files Supreme Court Amicus Brief on behalf of Public Justice

Yesterday on March 26, 2026, Gibbs Mura partner Amanda Karl and attorney Sadie Hillier submitted an amicus brief on behalf of Public Justice in the matter of Bestwall LLC v. Official Committee of Asbestos Claimants.

Hundreds of thousands of Americans have become very sick or died from exposure to Georgia-Pacific’s asbestos-containing products. Many of these people and their loved ones sought justice through the courts, but GP found a way to stop them, pioneering a tactic now known as the Texas Two-Step. This move allows companies to take advantage of bankruptcy’s uniquely powerful tools–including stopping lawsuits against it–even when they are not at all bankrupt. Other corporations have followed, halting their victims’ access to justice. While most courts have kicked Texas Two-Steppers out of bankruptcy court, the Fourth Circuit law has allowed them to continue stopping victims’ lawsuits.

The brief submitted by Amanda and Sadie urges the Supreme Court to review, and ultimately stop, this corporate abuse of the bankruptcy process, so the people harmed by these corporations can pursue the justice they deserve.
